Pregnancy Rights of the Father

A man who impregnates a woman does have rights during the pregnancy, but it can be difficult going against the mother's wishes. Most actions may require a court date.

  1. Abortion

    • While a father may be able to get a court order barring the mother from having an abortion, all too often he is not told until after it has been done. Once she has the surgery, there is nothing he can do.

    Adoption

    • If the mother wishes to give the baby up for adoption once it is born, the father has the right to seek custody of the child. He must prove to the court that he is the biological father before he can be granted custody.

    Paternity

    • If a woman becomes pregnant and tries to legally claim you as the father, you have the right to be genetically tested to determine if the baby is yours. If you are the father, you are legally obligated to help take care of the child.

    Doctor's Visits

    • If you are the father and want to be involved during the pregnancy, but the mother does not want you to be present, there is little recourse until the baby is born. Once the child is born you can seek visitation or custody.

    Considerations

    • If you are the father, it may be in your best interest to try and seek a mutually beneficial agreement with the mother before going to court.
